Please carefully read the following Terms of Service before
registering for an account and using the ISOTOTAL Quality First s.r.l. Service.
By registering for an account on ISOTOTAL Quality First s.r.l. online applications, you
or the entity you represent ("you" and "your") agree to be
bound by these Terms of Service (the "Terms"), which govern your
access to and use of the ISOTOTAL Quality First s.r.l. Service
(the "Service") offered by ISOTOTAL Quality First s.r.l.
("we", "us" or "our").
Our Privacy Policy are incorporated into these
Terms.
If you are registering for the Service on behalf of an
organization, you are agreeing to these Terms for that organization and promising
that you have the authority to bind that organization to these Terms. In that
case, "you" and "your" will refer to that organization.
It is important to note that the functionality of the Service is
time-dependent and these Terms represent the
functionality as of now.
1. Your Account
You agree to provide us with accurate and complete information
when you create an Account (your "Account"). In
order to prevent unauthorized access to your Account, you agree to keep
your password and other Account details confidential and not share them with
anyone else.
You, as the Account holder (local admin), are solely responsible
for access to, content in or sharing and use of your Account. We are not liable
for any loss or damage arising from any access to, content in, or sharing and
use of your Account. If you believe there has been unauthorized access to your
Account, you must notify office@isototal.net immediately.
By using the Services, you agree that you:
(a) are solely responsible for obtaining sufficient rights to the
content of all data and files stored by you on ISOTOTAL Quality First s.r.l. servers;
(b) will not violate, or encourage or facilitate the violation of,
any aspect of our Acceptable Use Policy;
(c) will not use the Services to sell and/or distribute digital
content to others. (The Services are not for storing and disseminating large
amounts of data to large number of recipients or for dissemination of digital
content for commercial purposes, and we may use procedures, which may vary from
time to time, to detect unacceptable levels of usage and may immediately
disable offending accounts based on detected misuse. We are not responsible for
any business interruptions that may be caused due to this process); and
(d) will not access or attempt to access the Services by any means
other than those provided on the ISOTOTAL Quality First s.r.l. website.
If there is suspicion that an account is being used for storage
and distribution of any illegal material such as copyrighted content, we
reserve the right to examine the content. We may also access the account and
data for support related activities. We normally do not review, inspect, edit or monitor any content, data or files stored by you or
any other user of the Service. We reserve the right to refuse, remove or
disable access to any data or files stored on our servers with immediate effect
that we determine may be illegal, may violate these Terms, may violate the
rights of any third party or otherwise may be reasonably objectionable.
3. Registration Information / Privacy
You agree to promptly notify us of any change in the information
you provided during your registration for the Services (including, without
limitation, any change in your mailing address, telephone numbers or email
address). The registration information (including your selected username and
password) provided by you during your registration for the Service, together
with any and all updates provided by you from time to
time under this paragraph, is referred to in these Terms as the
"Registration Information." Our policy regarding the privacy and use
of the Registration Information is set forth in our Privacy
Policy. By accepting these Terms, you are also acknowledging that you
agree to the terms of the Privacy Policy .
We may send SMS/emails to update you on any product reminders,
updates, events.
4. Additional/Sub-accounts
ISOTOTAL Quality First s.r.l. includes a Sub-accounts feature. The main
account holder (Local admin) may be responsible for actions arising from
Sub-accounts account holders, and is responsible for
ensuring all such accounts adhere to these terms.
The main account holder will set up username and
password for the Sub-accounts. An email will be sent to the Sub-account user
with this sign in information. It is the Sub-account user's responsibility to
change the password on the account. If the main account holder retains the
usernames and passwords of the Sub-accounts, he/she will have read/write access
to the Additional/Sub-accounts including access to profile information and
data.
Primary Support responsibility related to Sub-accounts resides
with the main account holder.
A main account holder has the authority to cancel the Sub-accounts
as well as the main account, for any reason. If due to non-payment, ISOTOTAL
Quality First s.r.l. reserves the rights to cancel
main account and Sub-accounts.
5. Service description
Service and applications offered by ISOTOTAL Quality First s.r.l consist in development, hosting
and maintenance of a web site, accessible through internet connections on any
device capable to run a web browser (Chrome, Edge, Safari, etc.). The address
of the website will be a subdomain of isototal.net or isototal.ro
(company.isototal.net).
Our applications has main users in
companies of industrial fields (automotive, manufacturing of goods), but not
only. The applications were designed to facilitate implementation and maintain
of the Quality Management Sistems according
ISO 9001 and IATF standards.
The list of the application (with main features) integrated in our
service is available online at address https://isototal.net.
We do not offer shared applications, and each customer receives an
individual website that is complete separate from the websites of other
customers.
6. Security
Account Passwords
You are solely responsible for any consequences arising out of your failure to
maintain the confidentiality of your Account password. You will notify us of
any unauthorized use or breach in security of your Account immediately after
you learn of such unauthorized access or use. We advise frequent changes to the
Account password for better security. The automated forget password option
works on the assumption that only the account holder has access to the email
address on record. In case the user does not have access to the email address,
other means of verification may be used including billing information to verify
identity.
We endeavor to restrict access to the data and files you store or
retrieve from your Account to persons you have authorized to access your
Account. However, no password-protected system of data storage and retrieval
can be made entirely impenetrable. Accordingly, you hereby acknowledge that it
may be possible for an unauthorized third party to access, view, copy, modify
and distribute the data and files you store in Your Account.
Encryption System
Based on your privacy and security needs, but to protect also
our servers, we use an encryption process that encrypts the data contained
within the files that you upload on our servers. Certain metadata related to
files including file thumb derivatives may not be encrypted. These metadata and
derivatives are necessary for faster display and search. For web and mobile
based data transfers, data is sent over an encrypted channel.
While your data is still encrypted, ISOTOTAL Quality First s.r.l. personnel may still be able to decrypt your
data, but only at your request. We understand and agree to not communicate to
third parties information related your data that may
be exposed to us.
7. Use of IP Addresses
We may collect IP addresses for the purposes of system
administration and/or to audit the use of our site. We can and will use IP
addresses to identify a user when we feel it is necessary to enforce compliance
with our policies, Terms, or to protect our service, site, customers, or
others. Some services, such as user logs and registration emails, may also
display IP addresses.
8. Backups of Your Data
We perform daily backups of your data (once a day).
ISOTOTAL Quality First s.r.l. offers
you now, a local backup capability (archive to your computer) and we strongly
encourage our users to make full use of this. This feature is offered for no
additional fee. Online or Cloud Backup should always be a complementary
solution to local backup and not be the ONLY solution.
9. Billing
Automatic Renewal - Paid Plans
In exchange for use of our Services, an invoice will be issued, according to the
billing plan selected by You (a period of one month is free of charge after
registration, when You can cancel Your account without any cost).
Please refer to price list table available online at address
https://isototal.net.
You also agree that the enrollment for the next service period is
automatic and paid in advance.
Any price changes or changes to your subscription plan will take
effect following notice to you and after current plan will expire.
Any request from your side, for changes in the functionality of
the service will be treated with additional invoices based on an offer accepted
by you.
If the account is cancelled for any reason, user data and its
backups will be removed from our storage servers after a period of 10 days.
Taxes
You’re responsible for all applicable taxes, and we’ll charge tax when required
to do so. ISOTOTAL Quality First s.r.l. can rely
on the name and address you provide to ISOTOTAL Quality First s.r.l. as being the place of supply for sales tax,
income tax, and VAT purposes.
Cancellation & Refunds
You must cancel your Account before it renews , in
order to avoid a charge for the next month's or year's fees.
We will not issue any pro-rated refunds for the remaining period
of a year/years when an account with a subscription plan ("current
plan") is downgraded to a smaller plan ("new plan") during the
middle of period of current plan, for which You already paid.
10. Class Action Clause
You agree that Class Actions are not allowed and all disputes with
ISOTOTAL Quality First s.r.l. must be resolved
on an individual basis. You may not bring any claim against ISOTOTAL Quality
First s.r.l. as a class member. This includes
class arbitrations, class actions, private attorney general actions, and
consolidation with other arbitrations. Regardless of whether any such dispute,
controversy or claim concerns any other individual / entity, multiple
individuals / entities, or other persons, classes of individuals, or entities,
all cases shall be decided between ISOTOTAL Quality First s.r.l. and
the individual only.
11. Termination
We may, at our option and in addition to other remedies,
immediately and without notice terminate these Terms at any time or suspend
your access to the Services: (i) if you breach any
provision of these Terms; (ii) if we are required to do so by law; (iii) if we
cease to offer any services covered by these Terms; or (iv) for any other
reason with thirty (30) days prior written notice to you (or sooner if you are
flagrantly violating these Terms or are a threat to users or the Services).
You may terminate these Terms at your convenience by informing us
at least thirty (30) days prior. Should you object to any of these Terms or any
subsequent modifications thereto or become dissatisfied with the Services in
any way, your only recourse is to immediately: (a) discontinue use of the
Services; (b) terminate these Terms; and (c) notify us of such termination.
Upon any termination of these Terms, we will remove stored in ISOTOTAL Quality
First s.r.l. backup and/or ISOTOTAL Quality data
files from main storage and archives within 10 days.
12. Notices
Any notice under these Terms given by ISOTOTAL Quality First s.r.l. to you will be deemed to be properly given if sent (i) by email to your email address as set forth in the
Registration Information, (ii) by a startup screen that starts before your next
use of the Services, (iii)
by a display about the changed information in the Terms on our
website. It is important that you maintain a correct working email address and
update it if necessary to be able to receive our communications. To ensure
proper delivery of email communications, please whitelist '@isototal.net’ and '@isototal.ro’
domains in your email spam filter.
Any notice under these Terms provided by you will be deemed to be
properly given if received by Customer Service at office@isototal.net, except those
that are related to cancellation or termination of your Account. 'Cancel at the
end of your annual term' is available online by disabling auto-renewal option.
For special cases where you’d like to close your account prior to the end of
your annual subscription term, please contact us. On successful cancellation of
an account by you or by us, due to various reasons including non-payment for
the Services, your data will be removed from our storage servers. We may delay
the cancellation related to non-payment for the services and provide a grace
period of up to thirty (30) days from the due date to allow for the customer to
arrange for payments.
Fair Use Notice: Any copyrighted materials used
in this website, like third-party logos (Windows, Mac, Linux 'Tux' etc) are the property of their respective owners/companies.
13. Modifications to this Agreement
We may change these Terms from time to time and the most current
version will always be posted on our website located at https://isototal.net. For any
revision of this material we will notify you (e.g.,
via email). Your continued use of the Services after such revisions become
effective will constitute your acceptance of such changed terms and conditions.
If you do not agree to the new terms, please stop using the Services.
14. Miscellaneous
THESE TERMS
AND THE USE OF THE SERVICES AND SOFTWARE WILL BE GOVERNED BY ROMANIA LAW AND
EUROPEAN UNION LAW. You will commence any claim or cause of action arising
under or otherwise occurring by reason of these Terms within one (1) year after
the claim or cause of action arises or such claim or cause of action is forever
barred. These Terms create no third party beneficiary
rights. You may not assign any of your rights in these Terms, and any such
attempt is void. ISOTOTAL Quality First and you are not legal partners or
agents; instead, our relationship is that of independent contractors. Our
failure to insist upon or enforce strict performance of any provision or right
of these Terms will not be construed as a waiver of any provision or right.
These Terms constitute the entire and exclusive agreement between you and ISOTOTAL
Quality First s.r.l with respect to the
subject matter hereof and supersedes any and all prior and contemporaneous
understandings and agreements.
Privacy Policy

ISOTOTAL Quality First s.r.l. has
created this Privacy Policy in order to demonstrate
our firm commitment to privacy. The following discloses our information
gathering and dissemination practices.
Users can access ISOTOTAL Quality First s.r.l. services
(the "Services") through our online applications on Devices. A
"Device" is any computer used to access the Services, including
without limitation a desktop computer, laptop, mobile phone, tablet or other
consumer electronic device. This Privacy Policy governs your access to ISOTOTAL
Quality First s.r.l. Services, regardless of how
you access it, and by using our Services you consent to the collection,
transfer, processing, storage, disclosure and other uses described in this

Files - We collect and store the files and data you upload on
our servers using our Services.
Session Records - To maintain our quality of service and to
assist in the analysis of product performance, we may also gather data on
connection information, including the timing and size of all packets sent over
the Internet during a session, session date and times, Device Internet Protocol
("IP") address, browser type, Device name and/or identification
number, and other interactions with the Service. The gathered information is
used to ensure the highest quality experience possible.
Cookies - We use "cookies" to collect information
and improve our Services. A cookie is a small data file that we transfer to
your Device. We may use "persistent cookies" to save your
registration ID and sign in password for future sign in to the Service. We may
use "session ID cookies" to enable certain features of the Service,
to better understand how you interact with the Service and to monitor aggregate
usage and web traffic routing on the Service. The cookies are used solely for
identifying user sessions and do not store any personal information regarding
the user.
What Do We Do With Gathered
Information? Information gathered by us may be used: (i) to provide complete
functionality to our Service, (ii) to administer your use of the Service, (iii)
to better understand your needs and interests, (iv) to personalize and improve
your experience, (vi) to send reminders and (vii) to provide product
announcements.
We may send SMS/emails notifications to update you on any product
reminders, updates, events. We may use the email addresses and mobile numbers
provided by you to send periodic information about our Services and related
products.
Who Do We Share Information With? We do not voluntarily share
personally identifiable information with any third party without the user's
express consent or unless compelled by applicable state and federal laws (see
below). We practice a no-sharing policy for subscriber information to
third-party.
Users - We will display your personal information in your
profile page. You can review and revise your profile information at any time by
accessing your account settings.
Business Transfers - If we are involved in a merger,
acquisition, or sale of all or a portion of our assets, your information may be
transferred as part of that transaction, but we will notify you (for example,
via email and/or a prominent notice on our website) of any change in control or
use of your personal information or files, or if either become subject to a
different Privacy Policy. We will also notify you of choices you may have
regarding the information.
Non-private or Non-Personal Information - We may disclose
your non-private, aggregated, or otherwise non-personal information, such as
usage statistics of our Service.
Access Rights and Choices to Limit Sharing You have the
right to request access to all personal information ISOTOTAL Quality First s.r.l. collects about you by contacting office@isototal.ro. Your personal
information may also be accessed from your Personal Profile page after logging
in to your account where you can correct, amend, or delete information related
to your account.
You may also make requests to limit the sharing of any of your
personal information by contactingoffice@isototal.net.
Data Retention We will retain your information for as long as
your account is active or as needed to provide you our
Services. If you wish to cancel your account or request that we no longer use
your information to provide you Services, you may delete your account through
the account settings after signing in to our Service from our website. Your
files will automatically be removed from our servers within 10 business days of
cancellation. Please note, that there might be latency in deleting backed-up
versions of files that may exist after deletion. We may retain and use your
information as necessary to comply with our legal obligations, resolve
disputes, and enforce our agreements.
You, as the Account holder, are solely responsible for access to,
content in or sharing and use of your Account. All content uploaded to the
service is based on your consent provided to the applications.
Security We take reasonable precautions to protect personal
information in our possession from loss, misuse and unauthorized access,
disclosure, alteration and destruction. User data is password protected and
your password should never be shared with anyone. We secure our service using
industry standard SSL.
Our Policy Toward Children Our Services are not
directed to persons under 13. We do not knowingly collect personally
identifiable information from children under 13. If a parent or guardian
becomes aware that his or her child has provided us with personal information
without their consent, he or she should contact us at office@isototal.ro. If we become
aware that a child under 13 has provided us with personal information, we will
take steps to delete such information from our files.
Changes to our Privacy Policy This Privacy Policy may
change from time to time. If we make a change to this privacy policy that we
believe materially reduces your rights, we will provide you with notice (for
example, by email). We may provide notice of changes in other circumstances as
well. By continuing to use the Service after those changes become effective,
you agree to be bound by the revised Privacy Policy.

uses of the services offered by ISOTOTAL Quality First (the “Services”). The
examples described in this Policy are not exhaustive and we may modify this
Policy in time.
By using our Services, you agree to the latest version of this
Policy. You agree not to misuse the Services and we reserve the right, but do
not assume the obligation, to investigate any violation of this Policy or
misuse of the Services. If you violate the Policy or authorize or help others
to do so, we may suspend or terminate your use of the Services.
For example, you must not use, or encourage, promote, facilitate
or instruct others to use, the Services to do the following things:

use the Services for any illegal purposes;

use the Services to store, retrieve, transmit or view any file,
data, image or program that contains:
o any illegal
pictures, materials or information;
o any harassing,
libelous, abusive, threatening, harmful, unlawfully pornographic, vulgar,
obscene, fraudulent, deceptive or otherwise objectionable material of any kind
or nature;
o any material
that encourages conduct that could constitute a criminal offense, give rise to
civil liability or otherwise violate any applicable local, state, national or
international law or regulation;
o any code or
material that violates the intellectual property rights of others; or
o any viruses,
worms, malware, "Trojan horses" or any other similar contaminating or
destructive features;

use the Service for any spamming, chain letters or other use that
may otherwise disrupt the Service or the networks through which you access and
use the Services;

interfere with or disrupt any user, host, or network, for example
by sending a virus, overloading, flooding, spamming, or mail-bombing any part

access authorization or duplicate, modify, distribute or display any of the
data or files from any such account.

probe, scan, or test the vulnerability of any system or network;

breach or otherwise circumvent any security or authentication measures;

shared areas of the Service you have not been invited to, or Isototal Quality First computer systems;

access or search the Services by any means other than our publicly
supported interfaces;
·
send unsolicited communications, promotions or advertisements, or spam;
·
send altered, deceptive or false source-identifying information,
including “spoofing” or “phishing”;
·
violate any regulations, policies and procedures of networks
through which you access and use the Services; or
